TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POCKET PARTY, ITS OWNERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR PRODUCTS, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF DATA. USERS ASSUME ALL RISK AND FULL RESPONSIBILITY FOR THEIR ACTIONS AND THE USE OF ANY PRODUCTS PURCHASED. IN NO EVENT SHALL THE COMPANY'S TOTAL LIABILITY TO YOU EXCEED THE TOTAL AMOUNT PAID BY YOU TO POCKET PARTY FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

You agree to defend, indemnify, and hold harmless Pocket Party and its owners, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Site.
• Your violation of any term of these Terms and Conditions.
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
• Any claim that your use of a product caused damage to a third party.

All content on the Site, including text, graphics, logos, images, and software, is the exclusive property of Pocket Party or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. Unauthorized use is strictly prohibited.

The Site may contain links to third-party websites. These links are provided for convenience only, and Pocket Party does not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party sites. You access them at your own risk.

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms. By using the Site, you consent to the collection and use of information as detailed in that policy.

Pocket Party reserves the right, at its sole discretion, to modify or replace these Terms at any time. Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively through binding arbitration or in the state or federal courts located in Ontario, Canada, and you consent to the personal jurisdiction of such courts.
